Provider Terms of Service and Quality Standard

1. Ownership and Scope of Service

This document governs the commercial agreement between Juan Bautista Morales Barrigüete (owner of TenUnCuerpo10.com, Tax ID ES50173115H, based at C/ Zurbarán 6, 28670 Villaviciosa de Odón, Madrid, Spain) and independent beauty professionals, makeup artists, hairstylists, tanning specialists, and competition service providers («the Provider»).

Subscribing to any provider plan (Events Pack, Calendar PRO, or Premium) constitutes a B2B digital media advertising and software-as-a-service (SaaS) agreement comprising:

• Personalized Public Booking Webpage: Creation and maintenance of a custom public URL (tenuncuerpo10.com/proveedor/name/) featuring an interactive portfolio, direct dynamic WhatsApp appointment button, and social links.
• Private Provider Dashboard: Tool to manage attended events, toggle sold-out statuses, and update contact information.
• Event Calendar Presence: Insertion of verified provider badges and booking cards on selected event pages across TenUnCuerpo10.com.
• Automated Waitlist Routing: Routing athlete inquiries to the provider's WhatsApp when an event is marked at full capacity.

2. Independence from IFBB Federation & Non-Official Nature

Contracting this service grants the Provider visibility strictly within TenUnCuerpo10.com digital media and directories. TenUnCuerpo10 makes no representation that the Provider is an officially certified contractor of the IFBB federation or entitled to institutional federation placement.

3. TenUnCuerpo10 Commitment: Uptime and Technical Support

TenUnCuerpo10.com commits to technical excellence and dependable infrastructure:

• Platform Availability (Hosting & Software): Guarantee high-speed hosting uptime, database stability, and seamless functionality of the provider booking webpage and dashboard.
• Customer Support: Provide diligent assistance regarding profile updates, portfolio uploads, or WhatsApp integration questions.
• Uptime Guarantee: Should unscheduled downtime attributable to TenUnCuerpo10 infrastructure exceed 5% in any calendar month, the Provider shall be entitled to an equivalent pro-rata extension of their active subscription.

4. Social Media Promotion Policy

As an added courtesy, TenUnCuerpo10 may periodically highlight verified providers on its official social channels (e.g. Instagram).

5. Obligation of Means vs. Business Results

TenUnCuerpo10 assumes a strict obligation of means and visibility: delivering high-visibility event placements, indexable directories, and reliable routing to the Provider's WhatsApp, Telegram, or booking channels.

TenUnCuerpo10 DOES NOT guarantee a minimum number of client bookings, athlete leads, or revenue. Business performance depends entirely upon:

• The quality, appeal, and presentation of the Provider's portfolio.
• The competitive pricing and clarity of their service packages.
• The responsiveness, friendliness, and professionalism shown when replying to athletes via WhatsApp or Telegram.
• Active placement of the Provider's custom link in their own Instagram bio and promotional materials.

6. Direct Contractual Relationship Between Athlete and Provider

TenUnCuerpo10 acts purely as an advertising showcase. TenUnCuerpo10 is neither an agency, broker, nor contractual party in beauty or tanning services booked between athletes and providers.

• The Provider independently determines their service rates, deposits, schedules, and cancellation policies.
• Financial transactions occur directly between the athlete and the Provider without platform intervention.
• TenUnCuerpo10 bears no liability for service delays, disagreements, or cancellations between athletes and providers.

7. Strict No-Refund Policy (B2B Commercial Terms)

Contractual Rationale:

• Reserved Category Placement: Enrolling secures a capped spot per event and discipline, preventing competitors from booking that exclusive inventory.
• Immediate Infrastructure Deployment: Webpage generation, tracking asset creation, database indexing, and server resources are provisioned instantly upon payment.
• B2B Agreement (No Statutory Consumer Right of Withdrawal): As a commercial contract between independent professionals/businesses for business purposes, statutory consumer 14-day cooling-off / withdrawal rights (EU Directive 2011/83/EU) DO NOT apply.

8. Quality Standard and Verified Provider Badge

The «Verified Makeup Artist / Official Stylist» badge represents a standard of trust for competing athletes. To maintain verified status, the Provider commits to:

• Competition Punctuality & Flexibility: Showing reasonable diligence and flexibility regarding event timing changes (running orders, weigh-in schedules), keeping athletes informed proactively.
• Portfolio Authenticity: Guaranteeing all uploaded imagery depicts genuine work executed by the provider or their direct team.
• Capacity Updates: Engaging the «Sold Out / Waitlist» toggle in their dashboard promptly once fully booked, protecting athletes from false availability.

9. Code of Conduct and Right to Terminate for Misconduct

Competitor well-being is our highest priority. TenUnCuerpo10 reserves the right to immediately suspend provider visibility and revoke verified badges without refund in cases of:

• Failing to show up for confirmed client appointments on show day without genuine medical or emergency cause.
• Unprofessional or disruptive behavior in the backstage area damaging athletes or the competition environment.
• Publishing portfolio photos not created personally by the provider or submitting fraudulent credentials.

10. Plan Duration, Standby Mode and Right to Erasure (GDPR)

Plans have fixed terms (6 months for Calendar PRO, 12 months for Premium, or event completion for Events Pack). There are no surprise automatic renewals.

Upon plan expiration without renewal, listings enter standby mode. Data, media, and event assignments remain securely preserved for seamless reactivation upon future renewal, unless the Provider explicitly requests the permanent deletion of their account and media in accordance with the General Data Protection Regulation (GDPR / LOPDGDD), in which case all data will be permanently and irreversibly erased.

11. Applicable Law and Jurisdiction

This agreement is governed exclusively by Spanish law, incorporating European Union commercial and digital services directives.

In accordance with commercial law for business-to-business (B2B) transactions, both parties expressly agree that any dispute or litigation arising from this service shall be submitted exclusively to the Courts and Tribunals of the City of Madrid (Spain), as the registered domicile of the service provider, waiving any other jurisdiction that might correspond to them.
